Welcome to TheColdLady.com! These Terms of Service ("Terms") explain the rules for using our website and buying from us. The Site is operated by Koba LLC ("TheColdLady," "we," "us," or "our").

By visiting our Site or placing an order, you agree to these Terms and to the policies linked on this page. If you don't agree, please don't use the Site.

Our store is powered by Shopify, which provides the e-commerce platform we use to sell our products to you.

1. Adults Only (18+)

TheColdLady sells adult products. To use this Site or place an order, you must be at least 18 years old, or the age of majority where you live if that is higher. Minors may not use this Site, even with a parent's or guardian's permission.

By using the Site, you confirm that you meet this requirement and that buying adult products is legal where you live.

2. Placing an Order

  • When you place an order, you're making an offer to buy. Your order is accepted only when we ship it.
  • You agree to give us accurate, complete, and current information, including your name, email, billing and shipping addresses, and payment details.
  • We may refuse or cancel any order, or limit quantities per person, household, or order. This includes orders that appear to come from resellers or that we suspect are fraudulent.
  • If we change or cancel your order, we'll try to contact you using the email or phone number you gave us, and we'll refund any amount charged.

3. Prices & Payment

  • All prices are shown in the currency selected on the Site and may change at any time without notice.
  • We accept the payment methods shown at checkout. All payments are processed securely and encrypted. We never store your full card number.
  • If a product is listed at the wrong price because of an error, we may cancel the order and refund you, even after it has been placed.

4. Shipping & International Orders

  • We ship to almost every country in the world. You'll see shipping costs and estimated delivery times at checkout before you pay.
  • International customers are responsible for any customs duties, import taxes, or fees charged by their country, and for making sure the products are legal to import and own there.
  • Delivery times are estimates, not guarantees. Delays caused by carriers or customs are outside our control.

5. Returns & Refunds

Returns, exchanges, and refunds are handled according to our Refund Policy. For hygiene reasons, some intimate products may not be returnable once opened. Please check the Refund Policy before you order.

6. Product Information

  • We do our best to describe and show our products accurately, but colors may look different depending on your screen, and packaging may change from what's pictured.
  • Products may be available in limited quantities, and we may discontinue any product at any time.
  • Our products are meant for adult personal use. Always read and follow the manufacturer's instructions and warnings, and talk to a doctor if you have health concerns, allergies, or a medical condition.
  • Information on our Site, including blog articles and guides, is for general informational purposes only and is not medical advice.

7. Your Account

If you create an account, you're responsible for keeping your password safe and for all activity under your account. Please let us know right away if you think someone has used your account without permission.

8. Reviews, Comments & Feedback

If you send us reviews, comments, ideas, or suggestions, you agree that we may use, edit, publish, and share them in any medium, without paying you or keeping them confidential.

You agree that anything you submit:

  • Is honest and your own
  • Doesn't break any law or infringe anyone's rights, including copyright, trademark, or privacy
  • Doesn't contain viruses, spam, or abusive, threatening, or defamatory content
  • Doesn't pretend to come from someone else

We may remove any content we consider inappropriate, but we aren't required to monitor submissions.

You may not use the Site to:

  • Infringe our intellectual property or anyone else's rights
  • Harass, abuse, threaten, or discriminate against anyone
  • Submit false or misleading information

We may end your access to the Site if you break these rules.

Our Site may include third-party tools, such as payment providers and apps, and links to other websites. We don't control these services and aren't responsible for their content, products, or practices. Your use of them is at your own risk and subject to their terms.

How we collect and use your personal information is explained in our Privacy Policy.

13. Errors & Updates

Our Site may sometimes contain typos or errors in product descriptions, prices, promotions, shipping costs, delivery times, or availability. We may correct errors, update information, or cancel orders at any time without notice, including after you've placed an order. If we cancel an order, you'll get a full refund.

14. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available." To the fullest extent allowed by law, we make no promises or warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, durability, or non-infringement. We also don't guarantee that the Site will always be available, uninterrupted, secure, or error-free.

This doesn't affect any manufacturer's warranty, or any rights you have under consumer protection laws that can't be waived.

15. Limitation of Liability

To the fullest extent allowed by law, Koba LLC and its owners, employees, partners, suppliers, and service providers are not liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the Site or any product bought through it. This includes lost profits, lost data, and replacement costs.

Where the law does not allow these limits, our liability is limited to the maximum extent the law permits.

16. Indemnification

You agree to protect and hold harmless Koba LLC and its owners, employees, partners, and service providers from any claims, damages, or costs, including reasonable attorneys' fees, that result from your breach of these Terms, your violation of any law, or your violation of someone else's rights.

17. Termination

You can stop using the Site at any time. We may suspend or end your access at any time, without notice, if we believe you've broken these Terms. Any amounts you owe up to that point are still due.

18. Governing Law

These Terms are governed by the laws of the State of Florida, USA. Any dispute will be handled in the state courts of Manatee County, Florida, or the U.S. District Court for the Middle District of Florida.

If you live in the EU, UK, or another country with mandatory consumer protection laws, you keep any rights those laws give you.

19. Other Important Terms

  • Entire agreement: These Terms, together with our Privacy Policy, Conditions of Use, Refund Policy, and Shipping & Returns page, are the full agreement between you and us.
  • Severability: If any part of these Terms is found invalid, the rest still applies.
  • No waiver: If we don't enforce a term right away, we can still enforce it later.
  • Changes: We may update these Terms at any time. Changes take effect when posted here, and continuing to use the Site means you accept them.
